COLLECTION OF YOUR INFORMATION
In general, we collect the personal information that you submit to us voluntarily through the Services. We also collect information that you submit in the process of creating or editing your account and user profile using the Services. This may include, for example, your name, email address, cell phone number, height, weight, and gender. When you personalize your profile and use the features of the Services, we will collect any information you voluntarily provide, and we may also request optional information to support your use of the Services, such as your year of birth, and other demographic information. We collect information in the form of the User Content that you submit during your use of Services, such as communications, photos, comments, reviews, and other information you choose to submit.
We may collect your email address, and any information included with your email to us, and use it to contact you. We may also use your email address to notify you of offers from us or our partners related to the Healthy Turtle services.
If you use mobile-enabled services provided though the Services, including the Texting Service made available by us, we may receive information about your use of our services from your mobile device while you use our applications or services. Certain applications or services may also require addition information collection, such as information to be sent when you are not logged into the Services for alerts services, and the terms of such collection will be identified when you subscribe to or sign up for such services or applications.
We may also collect information that we do not attempt to associate with any particular user that becomes available to us as a result of your use of our Services. This information may include, for example, your IP address (a number automatically assigned to your computer when you use the Services, and which is logged by our servers), your Internet Service Provider (“ISP”), your web browser, the type of operating system, the domain name of the website which links you to our Services, the pages you visited, and the average time spent on the Services.
USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION
Healthy Turtle uses your information to communicate with you, to respond to your requests for information and to provide, maintain, protect, develop and improve the Services. The information we learn from users helps us personalize and improve the Services that we offer through them. When you register with the Services, make any posting or communication, or request any Healthy Turtle service such as personalized coaching, your personal information may be shared with third parties as necessary for the third party (including for example third-party coaches or trainers) to provide or facilitate the requested service.
Your personal information may also be used, either alone or in aggregate, for the following purposes:
• establishing and maintaining your relationship with us;
• responding to your requests and inquiries;
• customizing the content you receive from us and our partners;
• offering you additional information, opportunities, and functionality from us or on our behalf, or from our partners at your request;
• registering you for programs, events and/or services that you have requested;
• meeting legal, regulatory, insurance, security and processing requirements;
• consummating a business merger, sale, acquisition or transition where some or all of our assets (including your personal information) are sold or transferred; and
• in other ways with your consent.
Healthy Turtle uses third-party vendors, including Authorize.Net, the Apple iTunes/App Store, and the Google Play Store, to process credit card payments. Healthy Turtle does not collect, store, share or use any financial information, such as credit/debit card number, expiration date, or security code on the Services.
CHAT MESSAGES TERMS AND PRIVACY
By using the Services, you agree that Healthy Turtle may send and receive from you electronic chat messages and text messages in connection with the Healthy Turtle service and you expressly authorize such chat messaging and text messaging, including messages from your assigned coach(es) and (if authorized) your trainer(s), automated and pre-recorded messages, and messages delivered via automatic systems, and you agree to Healthy Turtle’s retention and storage of both sent and received messages.
By using the Services, you further acknowledge that text message and data rates may apply and you are solely responsible for any fees incurred from your carrier from receiving and sending chat messages and text messages and using the Services.
COLLECTION OF PERSONALLY IDENTIFYING INFORMATION FROM OR ABOUT CHILDREN
Healthy Turtle does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, you are prohibited from registering or sending any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to Healthy Turtle. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. LINKS AND THIRD PARTY APPLICATIONS
Healthy Turtle puts in place security measures to protect against the loss, misuse, and alteration of the information under our control. Healthy Turtle endeavors to ensure the integrity and security of our network and systems; however, we cannot guarantee that our security measures will prevent third parties from intercepting information. You acknowledge that you do not assume or expect that any content or communication that you transmit to us (such as personally identifiable or other data, questions or answers, comments, or suggestions) is confidential. Healthy Turtle shall not be liable or responsible if any information about you is intercepted and used by an unintended recipient or otherwise disclosed in a manner you did not intend.
DO NOT TRACK SIGNALS
